What kind of criminal charges can I file against a couple who has forged the signature of our dead aunt in order to have the papers for the house and lot transferred to their name? I have obtained a copy of the alleged legal deed of sale. The "sale" was done March 2006 but our aunt died November 2005. Am I right to say that the lawyer who notarized this as well the witnesses can also be filed charges as well?

My aunt left a handwritten will giving me the property. This couple(the girl is actually my cousin) I believe has an interest in this property and this is why they did this.

A hand-written will? Did you bring this forward back in 2005? At that time you should have hired an attorney to contest the sale of the house - why have you waited 4 years? I'm wondering if your cousin (your aunt's daughter, I assume) perhaps petitioned the court to declare that her mother died intestate (without a valid will) in which case your aunt's estate would have passed by law to her heirs - depending on the state most likely to a combination of her spouse (if he was still still alive) and her children. At this late date, I suggest you contact an attorney and ask him to look at this hand-written will and give you his opinion about it. Hand-written wills can be valid - IF they are properly drawn up and witnessed, so see what the attorney says.

I have to admit I was a bit complacent as I thought my cousin and her husband would honor and respect what my aunt wanted for this house. Obviously I was wrong. My aunt was never married nor had any children this is why she left this property to me.
