My son, his father , and I moved to vegas about a year ago. About 6 months ago his father left us and moved to California he's only called a handful of times sense then. About 2 weeks ago he told me he'll see me in court. He only seen him once and hasn't help with any child support. I haven't filed anything yet because I thought we could do this out side of court. Now I', worried he'll take me to court in California. I was wondering how I should go about to get soul custody? I don't feel it would be good for me 21 month year old son to go from here to there every month. I would like for his father to visit him here where his home is

Please pay more attention to posting guidelines. There is a Read First sticky in the Children forum (where this was moved from) that directs questions of a legal nature to this forum.
Also this site provides free help so using a subject like you did is superfluous.
The fact that you and the child live in Nevada, means Nevada has jurisdiction. You also can't complain that he hasn't paid support since you didn't go to court to compel him to.
So you need to go to court for a divorce and to establish custody. You want primary physical custody and joint legal custody. As for visitation, at this age, you could require that he pick up and return the child. If not that he only make local visits.
I would suggest getting an attorney, especially if he has one.

Scott thank you for your help. I'm sorry if I posted this wrong. I'm not complaining that he's not paying support I was just wondering if that was something to help me out. I'm also sorry you feel that this is pointless. I'm confused and just signed up to learn more facts. I guess I went to the wrong place. Once again thanks for your insight. I won't be using this site any more.

Excuse me? Who said anything was pointless? I was trying to help you use this site more efficiently.
I answered several of your questions. I told you what you need to do now and some things you will need to expect. So why are you upset?

To OP: What court papers have you received already ? If there was a filing then you should have gotten something by now.

Scott: Sorry I misread what you where trying to say. I didn't mean to sound upset. I'm in a confused state of mind over all this and don't want to make anyone feel as if I'm upset. Thank you once again for your insight. I have got to some good information from you.

This site is all about helping people do things right. Whether its using this site more efficiently or getting help dealing with a problem.
If you haven't received papers yet, I think you should take the upper hand and file yourself. File for divorce, custody and child support in your local Family Court.
