If the victim I assaulted is my baby mother and I pled guilty and am now on probation and have a restraining order on me but she wants me to see the kids more often and that can't happen with this order is there anything she can do to get me off it?

If she put the restraining order on you, she MIGHT be able to take it off. Judges won't do it automatically, though just because the victim wants them too. They need to take into consideration everybody's safety.

If the court put the restraining order on, it ain't coming off till your done with probation... Plus, I'll bet your probation RULES say that you're to have no contact with your victim.

So, you're not going to be able to go over there even IF the restraining order were lifted.

Nope. The judge put you on probation and only the judge can take you off.

Thanks ,I know the judge isn't going to do that considering I pled guilty and shouldn't have.

Well, there's your answer to the restraining order and the probation. It's not going to happen. She can want you to see the kids more, but guess what? If you listen to her you're liable to go to jail. Stay away until you are legally able to see the kids. Don't listen to her. She does not make the rules, the Judge makes the rules that you must adhere to.

You are already convicted ( plead guility) nothing is going to change that, And if you have paid all your fines and did any anger management or other required courses, you can ask to be taken off probation.

She could ask the court to take off the restraining order.

Her seeing you has nothing to do with visiting the kids, so she can merely see them at a neutral place anytime she wants??
