The question I have is

1). Can I claim standard deduction on the US-India Tax Treaty? If yes, what is the amount that can be used.

Yes, because you are STILL considered to be a student while on OPT, and Indian students CAN claim the standard deduction under Article 21 of the U.S.-India Tax Treaty.

For 2009, the standard deduction is $5,700.
