My daughter got a dwi in Colorado. The officer messed up the court date by putting last year (court date he set for 1/8/09 which has already past) and put the wrong car "make". Now he wants to reissue a ticket almost 2 months later. Can he do that? How long do they have to come back and reissue a ticket? I can't find anything on it anywhere. Thank you in advance. Also, without a warrant, can they come into my house to look for her even if she really isn't here. She hasn't changed her address from mine but doesn't live here. They came to my house last night at 3:30 in the morning and none of us could go back to sleep.

I don't think you can do anything about the date being wrong, specially if its only the year. The make of the car seems like it would be more in your favor. But what doesn't make sense. Why they would come to your house because of a ticket. I think your daughter may be leaving something out of the story. Or I missed understood you. You have more ways to get out of a speeding ticket but a dui I think you'e in for some trouble. Get a lawyer! That's your best bet.Sorry can't help, more.

The nut is right. The cops would NOT come to re-issue a DWI ticket at 3:30 in the AM if that was ALL that they were looking to do.
No, they can't come in your house without a warrant... But, I guess they did anyway... You MUST have let them in.
