View Full Version : Wife dies and does not leave house to spouse, I have a marriage license,

My wife of 27 years has passes away, she left the house we lived in together to her son, I am 86 years of age and could be homeless soon. She passed away 17 months ago=do I have any rights to the property. We have a marriage certificate but do not have a marriage license, I have shared all bills with her since we lived together..

If you are not on the deed and she left the property to her son in a will, then you will have to contest the will. Whether you have grounds to do so depends on the state (country, area) you live on, a key fact you left out.
Has the will been probated?

First marriage license, marriage certificate , that is our first issue
Where you legally married, did you go to the court house, get a marriage license and get married, either by judge, notory or pastor. So you will need for court if contested, a certified copy of the license from the court house.
Next you will need an attorney and will have to contest the will.
But she may well be able to leave the house to her son, so you need to discuss this with them

You definitely need to contact an attorney. I'm confused on the marriage certificate issue, but, depending on where you live, even if you weren't officially married you might have a common law marriage. Good luck!

If it was her house before you married, and your not on the deed, you will need more than a marriage license. You need a really good lawyer.
