Please help!!
My fiancé and I are going to see my family out of state for Thanksgiving, he is to have his children that weekend, we want the kids to go with us, but his Ex wife is refusing to let them go even if it is our time.
What would happen if we took the kids out of state with out her knowledge? He has joint physical custody of the boys.

Since he has joint physical custody of the boys, he should be able to take them anywhere he wants during his court-ordered visitation time. I'd play hardball with the ex and inform her that if she refuses to let your fiancé see them when scheduled then you'll press charges against her for contempt of court. Then be prepared to go through with it.

I'm not sure, but I think you have to have her permission. And the same she would have to do if she took them out of state. (since you guys have joint visitation) I would certainly call your lawyer on this and just ask. You don't want to get yourselves in trouble. And taking them out of state might end up with the mother causing more trouble. She has a right to know where her children are and so does the father.

If it does not state in your divorce decree that you can't leave the state and that you need to advise her... then tell her to @#$%off, she will be pist but legally can't do ANYTHING... trust me... been through this from the time my children were 12... til 18... many years of court battles
