My diverter is on the top of the tub faucet, when I turn off the water the diverter will not drop down on is own. I have to manually push the diverter down with my hand.

Just to be clear, your diverter is on the tub spout(where the water comes out) right? If so, you can usually take it apart and clean it up, or just replace the complete spout with a new one. How old is the spout, and what brand is it?

Yes the diverter is on top of the spout, don't know the brand & only 3yr old. Just started having a problem about 2 weeks ago.

How do I take the diverter apart?

Usually you can unscrew the handle and the insides will fall out. Takes a pair of pliers to get the handle unscrewed. Can you post a pic of your spout?

See the images below and tell us which one is your spout, it is cheap just remove and replace the whole assembly and you are done.

The spout looks like #5 w/ the diverter at the end of the spout. So your saying the spout can just unscrew from the wall to replace it.

This is slip on kind spout you would find a small slot on the underside of the spout and there is an Allen head screw. To remove the spout loosen the Allen Head Set Screw pull and twist the old one off, take it with you to Lowe's or HD get the same one and replace it. Use a little silicone GREASE to lubricate the new Oring just prior to installation so the new Oring doesn't bind and break,Good luck.
