View Full Version : Garnishment of 1099 income

I have a judgment and garnishment Writ (MC 12) issued in Michigan. The judgment is for a dispute of an unpaid credit card. I am a 1099 independent contractor in Michigan. The plaintiff has sent the writ to the company to garnish semi-monthly commissions. I pay my own expenses, staff, and overhead. What, if any can they garnish?

1099 is not salary or really commission but a contract payment based on your business billing the other company for services, I don't believe they will or can garnish this as income.

BUT, unless your business is set up as a corporation, these are funds you own, same as money in the bank and could attach not only a percent as with income but could possible freeze and take all of the money unless you have separated business and personal incomes
