View Full Version : Is it legal that my friend was fired because my other friend was caught shoplifting?

My friend was caught shoplifting a tester of perfume at sears, he is being charged and blah blah, but he gave the perfume to my other friend who works there, she didn't know it was stolen she thought it was just an early christmas gift, but now a week after the incident she has been fired, is that legal, or is she able to get her job back since her whole future relies on this because it is also her co-op... and sears has the perfume back also, so techinically no harm done except my friend was an idiot...

Sears can fire anyone they so please. She did receive the stolen merchandise. She can claim innocence of the fact it was stolen but she was in possession of stolen goods. Yes, Sears did the right thing in firing her. She can appeal her firing but I doubt if anyone will listen.

Let me see the little bottle with the big letters "tester" on it.

They may also assume that they were aware of the theft, esp since she ended up with it.

If they are firing her for Theft, they do have a duty to prove she was connected with the theft, So she could appeal that she had nothing to do with it.

But most likely they assumed ( as I also do) that she need about it, when it was given to her

So she should just leave it then
I figured she would probably do that anyway
Just wanted to see if their were in the right about it
