Hi. I live in Florida and my husband was a convicted felon. Is it legal for him to have a muzzleloader?I have been told this is not considered a firearm

Do not believe what people tell you or what we have to see in this matter since an error could mean a violation. Simply ask the states attorney's office or state police. Is he on probation or parole?

And who told you a muzzleloader wasn't a firearm, needto know ? It sure is my dear:rolleyes:

Edit: I can't think of anything more dangerous then this description of a muzzleloading firearm:

Muzzleloading can apply to anything from cannons to pistols but in modern parlance the term most commonly applies to black powder small arms. It usually, but not always, involves the use of a loose propellant (i.e. gun powder) and projectile, as well as a separate method of ignition or priming.

He is not on anything anymore. Has been off probation for a year now

Apparently it is your Federal law that prohibits any person who has ever been "convicted in any court of a crime punishable by imprisonment for a term exceeding one year" to ever or for any reason "possess... any firearm or ammunition." 18 U.S.C. 922(g)

There is your answer right there.

I think what is being asked is if a muzzle loader qualifies as a fire arm under the USC and it does, but not every size muzzle loader USC 921 spells out a great many guns and other things that qualify as a fire arm including land mines. However, certain bore size or caliber are excepted. This really isn't our call, they should be talking to the authorities to avoid a felony possession my a felon.

It is perfectly legal for a felon to have a muzzle loader. Black powder guns do not have a federal firearms background check.

Felons can ONLY possess black powder guns and bow and arrow.
