My daughter went to work at a beauty salon working on commission, she signed a non compete contract after she had been there for 11 months the salon decided to go to booth lease for their employees and had to sign a new contract, being that the salon broke the first contract and my daughter became self employed does the first contract for the non compete become void if she leaves this salon

While I think it does, in the end, the exact wording of the non ceompete and the exaxt wording of the booth lease may be the final say.
So and this sounds bad, she may not know what the court will rule until she quits, goes to work somewhere else and has the other location sue her

MOST non compete contracts are NOT enforceable. Not having seen THIS one, I couldn't say if it IS or NOT.
The Padre is right, though. The only way to tell with this contract, is to quit and let them sue... However, unless your daughter moves to another salon, and takes ALL the other salons business, I can't imagine that they would care that she's working down the road. Beyond that, I can't imagine they could AFFORD to sue her.
