Hi,

I am a Ph.D. student and currently working on my dissertation. My visa expired in June 2009. I came to India in May 2009 and leaving to USA again in January 2010. As my visa expired in June 2009 I need to get it renewed before I leave to US. Though I am in India since May 2009 I am enrolled at my university in the US. I read somewhere that a student will fall out of status if they are outside USA for more than 5 months. Can anybody tell me if I am out of status even though I am enrolled at the university.

I have a feeling that u have ,made a mistake of coming to India after the visa has expired, now till such time the visa is renewed you will not be able to get back to us as without a valid visa of at least 06 months validity one is not permitted to enter usa. In my view you should now get the visa renewed/extended/reissued as soon as possible so that you can still go back in jan 2010 which is today.

As a student, you are still able to fall out of status if:

1. Your I-20 is expired for 5 months or longer.
2. Your attendance records don't meet the requirements.
3. You study part-time.
4. You leave US for 5 months or longer.
