View Full Version : How can I get my resraining order lifted

I was put on probation & a restraining order was put in affect for domestic violence two years ago. Since then I have taken a 52 week batterers class. My p.o. told me it says in my paperwork that it can be lifted after I finish my classes but I wrote the judge twice & both times he denied my request because I violated the restraining order one yr before that. Is there any other way I can get the order lifted?

I'd retain an Attorney and file a formal request. Might be a Motion, might be an Order to Show Cause.

Why do you want the Order lifted? Is it by mutual consent? As a rule if you have no intention of contacting the other person these orders (in NY) stay in effect.

I'm in California and we have one child in common and we both have written the judge to have the order lifted.

If you have been denied and both agree to the lifting, I'd retain an Attorney.
