View Full Version : I was attacked by another tenant in my apartment complex

On November 1st I was walking out my own front door and I was taken by complete surprise by another tenant with force. I was knocked back into my own apartment and he hit and kicked me in the head several times at the end of the attract he stomped on my throat with his foot. I was taken away by ambulance to the ER for multiple head injuries. I did nothing to provoke this attack and was warned by the assailant not to call the police or there would be more trouble. The police was called and I was able to identify the guy (which lives directly upstairs from me) and press charges. I also filed a restraining order which has been granted. He has a court date set for the 4th of January for misdemeanor battery (which just blows me away this should be a felony).

When I signed the citizens arrest form from the Riverside police department they told me that they could not hold him due to the over crowding of the county jail and cited and released him. The very next day I walked out of my apartment to go to my own doctor he was standing three feet from my front door staring right at me. He left without incident. During the next thirty days I saw two raids take place and several individuals get arrested. For what I was told there was a huge theft ring coming out of one of the apartments. I also know first hand that these units use methamphetamines. My fiancé relapsed after ten years of being clean after we moved here August 1st. She has since gone into rehab and we are dealing with her addiction problem.

If I had my apartment door open they would walk by it and stare at me with hatred. I spoke to the onsite manager several times concerning my safety and the activities that was going on. I gave her names and apartment numbers and kept her informed of the status of the case I had going on. On one occasion she told me to stay in my apartment and keep my door locked. Why should I have to stay in my own apartment that I pay for and keep my door locked? I have called the police several times and even asked them if they could do walk through of the complex. They told me staffing issues would not allow it. I have to say this is the worst thirty days of my life. I was wiring my dead bolt shut with a hanger, hanging a pot on the door knob and sleeping with knives. I still could not get rest and this was affecting my job that I have had for thirteen years.

I was told verbally by the onsite manage that I could break my lease so I am in the process of moving all my stuff out now and I am not staying there anymore. I had to resort to renting a room and putting most of my belongings into storage.

Three days ago I received a three day pay or quit notice from the apartments. Yesterday the onsite manager asked me to right a statement to include dates so it coincides with her dates of all the illegal activities that has taken place. I am not sure if I should trust her on this matter and if I should take it to a lawyer. I cannot afford a lawyer. At one point last week she said that the assailant had been kicked out by the property management and I saw him there yesterday working on a car while I was packing. There is a serous meth problem there with three different units and the guy that attacked me is right in the middle of the drug involvement. I know he was high when he attacked me.

When the guy was served with the restraining order by the sheriff he did something because the sheriff called me and asked me what happened. I told him and he told me that I needed to watch my back because the guy responded in a way that was threatening. This guy also has a previous record involving violence which he went to prison for. The day after Thanksgiving I returned home after spending it down in Palm Springs. I noticed fresh blood drops right in front of my front door. For what I was told he attacked a female and that was her blood. She retaliated by getting some of her friends and attacked him with knives. I was also told they stabbed him three times. He has since been released from the hospital and back to his normal activities. He needs to go down for what he did so I am going to go through with the prosecution.

My questions are can the land lord hold me accountable for breaking the lease? Can I hold them accountable for not providing a drug free zone that they have signs posted for on the apartment complex and hold those accountable for there tenant issues? Also this is a gated community and one gate is left open all the time. The back wall in the parking lot is low in height and this where most of the traffic comes from.

One good thing I have seen out of this is the DA victim’s service center. They have supplied me with the information available to help me get back to my normal life which the very first thing will be counseling. I really need it after this experience. I have never felt so helpless and scared in my life after this experience. I am a veteran with eight years in the Army protecting our freedom and my freedom was taken from me on November 1st, 2009 at 9:30 AM. Stay away from Jefferson Street and Magnolia apartments in Riverside California.

They can try and keep drug dealers out, but the "dealers" have their own personal rights to privacy and to rules of evidence, so unless the police prove there is illegal things going on, the apt can not do anything.

You could have seen the height of the wall when you moved in,

But they may hold you accountable for breaking the lease. Criminal actvity within a area is not grounds to break a lease normally.

So what you need is not a "verbal" but have them put it in writing they are allowing you to move out
