Hi,

I've been separated from my husband for over a year, and am about to file for divorce. We currentlly have 50/50 joint custody for the kids. We get them every other week. Before we were legaly separated we went to file for ssi for our one child.. he has angelman syndrome. It's about 700 dollars a month. Months later after separation he tells me he's been receiving the check for months. He started giving half of the check month to month, but now he uses the check as leaverage. If I don't don't do this or that he won't give me the check. Am I leagaly intitled to half the check and if so what should I do? The check comes to his house and in his name... Please help

The child is legally intitled to the money, and who ever the court appoints as having primary custody will be the one to get it.

Is the 50/50 custody though the court, if so, is one of the parents having primiary legal custody if phsycial custody is divided.
