Hi,

I am staying in the US on L-1 visa since 23rd March 2009 onwards. My spouse and daguther(Both on L2 dependent visa) were here with me and left on 8th October 2009 to India, so I assume they both are a resident alien for the tax purposes.

I and my spouse have SSN and I need to apply an ITIN for my daughter. I have notarized photocopy of my daughter passport first page showing Name and photograph , last page and Visa but I don't have notarized photocopy of I-94 and as she is not in US anymore so we don't have I-94 for her.

Could anyone suggest me what to do in this situation, I will greatly appreciate your help.

You need ONLY the notarized photocopy of the picture page of her passport stapled to the Form W-7, which you will sign as the sponsor.
