View Full Version : Can I evict my tenant because of dirty animals and unwanted guests

I rent a room in my house to a girl. The lease allowed one dog and for her to clean up after the dog in the backyard. She has lived in the house for 2 months and has never picked up after the dog. She also has a cat which was not allowed in the lease. Today I told her that she was not to have her boyfriend kyle over anymore because I do not trust him. She tells me I can not legally make her not have guests but... her boyfriend has stayed for extended periods and he is not on the lease. She has also damaged my property a plastic chair which she threw off her balcony. Do I have grounds to evict her?

Give her a letter stating that she has violated the terms of the lease, so you are terminated the least in 30 days. You have to give at least 30 days notice. The lease and local laws, might require longer periods.
If she does not vacate by the deadline, you go to your local housing court and file for an eviction order.

In VA you will need to obtain an unlawful detainer. This is the official name of an eviction order. Check with your local housing court for the exact process of eviction.
