View Full Version : Filing child support for the first time after child is 18 yrs old

My boyfriend and his ex have a 12 year old daughter, he has been paying the mother in cash for the whole time and has no proof of the payments. He is scared to make her mad fearing she may go and file back child support on him. He thinks he can make her happy until the child is 18 and have his visitation and no court involved, After she turns 18 can the mother go back and say he has not paid anything? Is their a statue of limitations on child support with no court order?

If there is no Court order requiring child support there is no set amount your boyfriend has to pay. If the mother DOES file for support it would be retroactive to the date she filed.

He does not owe back support if no support was Court ordered.

The exception could be an agreement between them - in the form of a separation agreement, decree of divorce, support agreement.

The problem is that he " thinks ". Its always best to go to court and set it in stone so he can enjoy reguler visitation and holidays etc with his daughter. If he is already paying support then its no big deal anyway. How far off is what he is paying VS what he is suppose to be paying ?
Does he carry insurance on the child ?

He pays ova what Arkansas says he has to pay we did a child support calculator and for hia income he's paying over by about 50$ a month.
