My brother lives in California and will be off probation in June 07. Last week our mother was diagnosed with stage 4 breast cancer. He has asked for a transfer and was told NO. The PO did give him a pass to come to Oregon for 7 days. (attend mom's dr & chemo appts) He is the oldest child and my mom really wants him with her. Is there a family leave act for parolees, or people on probation? I'm afraid in June my mom might not be here.

No, there is no "leave" from probation, he will be one it, till it is over.

And only the probation department can give him permission for a visit or for a move. And no they don't have to let him move. Varoius states have agreements ( or don't have agreements) about interstate transfer of probaton or parole people.

He could appeal this to the supervisor, and hire an attorney to attempt to get it done.

Not only COULD he appeal the decision, but he SHOULD. FIRST, however, he needs to line up his ducks.

Yes, PO's care about a convicts parents... But, they care about him obeying the law more. BEFORE your brother appeals, he needs: 1) a job, 2) a place to live, 3) permission from the receiving state, and 4) a clear conduct record.

WHEN he has all those, he frames his WRITTEN appeal from the perspective that he MEETS the criteria for a transfer, and would they please expedite his request.
