View Full Version : No issued ticket for car accident

I got in a car accident and the police did not issue a ticket to anyone. A heavy duty gmc truck driver had road rage and he was trying to run me off the road... he hit me on the driver side and damaged my car to where its undrivable.. and he had no damage on his car besides the polices stupidity... do I have a chance of any compensation towards the cost for my car?

Depending on the department police do not have to ticket people. One inportant factor will be the police report, it should be several pages that include a drawing of how the accident happened, and a basic description of the accident which would show who is at fault.

Also since this was road rage, I would talk to the police officers supervisor or district capt and find out why a ticket was not done, if not even an arrest ( this action is far beyond a ticket and many states have specific laws on it)

Beyond that, you sue the other driver and/or the owner of that auto for all of your damages

He had no damage to his car, or to his tow truck ? Doesn't sound like you are telling the whole story. If it was road rage and the police were called, they would certainly have issued a citation if they had seen the problem first hand. If they came and saw that the both of you had lost it, then they aren't going to issue anything. They probably left it up to the both of you to sort it out.

As to compensation, you report the incident to your insurance company. They will pay for the damage less the deductible. They may then go after the other driver's insurance for reimbursement.
