View Full Version : Can you violate probation on a driving on suspended charge?

Okay. I was sentanced to 11 29 at 30% which I have recently served. The day I got out of jail I was put back on probation for a drug charge I had gotten in March of 09. (which was the charge that violated me) Anyway. All of my fines and fees are paid on all charges except my new simple possession charge (Ive only been on probation a month and I've only had to report once and I made payments towards probation fees and court fees and also passed a drug test) I go back to court on Monday for a charge that I had got back from the same time. The judge gave me 6 months to get my license back, but I received a letter from The Dept. of Safety stating that I cannot get my license until Feb. 2010. What do you think the judge will do? Do you think my PO will violate me, or do you think that the judge will give me time until I can actually get them?

Feb. 2010 is only 2 months away so that's within the 6-month time frame that the judge gave you, so there shouldn't be a problem.

You can not control what the rules of the DMV are. Merely have your attorney present this as evidence

Read it again, I stated I received it back when I got my other charge. December was my 6 month time.
The DMV said I can't get it until 2/7/2010. Not the judge.

I don't know about the judge in your driving cases. Who can say what they'll do? But, in answer to your above question, the answer is YES.
