View Full Version : Adoption vs guardianship how can you be sure which you did?

When my daughter was a baby her mother died and her maternal grandmother pressed me to allow her guardianship. I went to her lawyers office and signed papers which allowed her to have guardianship with the clause that if she became unable to care for her or died that all rights would revert back to me. She recently died and I tried to talk to her sons concerning my daughter future. Since it was in the middle of the school year and she was staying with my cousin I did not want to totally up root her so quickly after her grandmother's death. However, I have since learned that one of her maternal uncles has obtained either guardianship or adoption papers on her. It has been widely reported to me by her and others that she is being mistreated. How can I get my daughter? Unfortunately, I do not have copies of the papers. How can I get my daughter out of that situation? She is 14 years old. She wants to be with me. What are my options?

What State? She could not be adopted without the signatures of the birth parents unless there are very special circumstances which I do not see here. Did an Attorney review the papers you signed on your behalf before you signed them?

The only real way to know what has happened is to examine the court papers. You can get copies of the judgements from the court that has issued them. Otherwise your in the dark without reading it for yourself. This situation is not an easy one and there is a lot of room for abuse of the system when one party passes on and others take control.
