My Mom is 93 and was served with a summons to appear in court. Her heart is weak, and she has dementia. The debt is hers but she does not remember it. I can't bring her and put her through this. She has no savings, house or assets of any kind. What will happen if she does not appear?

The plaintiff will get a default judgment.

What I would do is answer the summons and include a doctor's note stating her condition. Ask that you be allowed to represent her.

Do you have Power of Attorney?

Hello s:

She'll have a judgment entered against her that can't be collected upon. Plus, your mother probably won't qualify for a mortgage or new credit cards...

Frankly, I don't think you're mother would mind having bad credit at this point in time... Besides, she's not even going to know about it.
