View Full Version : Independent employee on 1099 (student) tax filing

Hi everyone
I have the tax Related question. I am on the student visa (F1) On the OPT (optional practical training) I am working for the medical company as a independent employee. They filled from me 1099 form. And they are not deducting the tax from my paycheck. I am working since 17 February 2009 and may be up to January 2010. I didn't paid any taxes. So when I need to pay the taxes. Whether I will get tax return or not. Because I am on student visa I should get maximum return. I am worring that since I have not paid taxes they may add the penelty in the tax amount. So please help me what I need to do.

If you have not completed 5 years on F1/OPT, then you must file nonresident tax return. Your income is not subject to SS tax and Medicare tax. You will pay federal and state income taxes.
You need not worry about any tax not paid yet. File your return and pay taxes on or before April 15, 2010. Your U.S. Tax Return: U.S. Tax Filing Requirements for Non-Residents (http://taxipay.blogspot.com/2008/03/us-tax-filing-requirements-for-non.html)

But I have earned like more than 40000 $ last month I called to the IRS they told me if you owe us more than the 1000$ at the time of the tax filing then you may be penalized . I think don't know they are keep forwarding my call to the other person and they asked me very different questionthat are not related to my tax most of them don't know about the students getting most of tax return

If you did not have any income in 2009, then you will not be penalized even if you owe more than $1000.
Alternately, do an estimate of your federal income tax and pay before Jan 15, 2009.
