When I had emergency surgery 8/31/09, I was not insured. The hospital wants their bill of approximately $18,000 paid off in 18 months. Which is not possible. Is it possible to have this bill discharged in bankruptcy?

If you qualify for a Chapter 7, I believe you can. It is my understanding that medical bills are dischargeable along with credit cards.
I am filing in Ohio, though my medical bills aren't that high, they are being included

As a bankruptcy/tax consultant, yes, medical bills are dischargeable in bankruptcy. The only times where there might be a problem is when there is a suspicion of fraud or illegal felony activity in connection with the bill. If you had to have emergency surgery (for example -- falling off a ladder, hit by car, etc.) then you'll be fine. If you are planning to file, try to wait a few months. Large amounts of debt tend to raise eyebrows if you file too soon from the day the debt was incurred. Take care!

Yes, you can discharge medical bills along with credit cards during a bankruptcy. You may wish to wait until the hospital has filed a lawsuit for this money though and once the bankruptcy is filed it stops that lawsuit cold in its tracks. Bankruptcies are not cheap either. If done properly through an attorney you still have to pay the Federal filing fee plus the attorney's fee.

You can't of course merely just pick which bill that will or can't be.
Also you have to prove the need by showing amount of total debt to income and meet the guidelines in place now.

Also, you will be required to take a credit counseling class,which must be completed before you can get your discharge after filing

My Friend Attorney told him when the hospital discharges the account and when they sell it to another company you do not have to pay anyone because you did not agree to it or agreed to pay the other company but not sure if this is true does anyone know of this. Thanks EMF
