View Full Version : How do we get month to month tenants out just because we want them out - in NY State

My question is how do we get a tenant out of our two family house (we live in the other apartment) that we just want out - they're problem people and we want them out. We re bought the house a yr and half ago - they signed a year long lease with us that expired in July. Can we just serve them a 30 day notice? We don't want to get nasty with them and would like a smooth transition - we will need new tenants and would like to show the apt before they leave (we realize this may be difficult if we force them out) - What's the nicest way to get them out but still get them out -

I cannot find the real estate forum that has the landlord rights for each state - can you post the link to it with your answer or give the URL?

To make sure, give them written notice to vacate by 12/30. I would wait until 11/30 (the first business day after Thanksgiving--It wouldn't be nice to serve them before Thanksgiving).

As month to month tenants you can give them one rental period's notice.

As for showing the place, this should have been set up in the lease. The lease is still in effect except for term and rental. Generally, you need to give reasonable notice which is usually 24 hours.
