View Full Version : Age of consent to have sex with an adult in Ohio. What are the loopholes to this law

I am 33 yrs. Old from Ohio. I had a boyfriend that is 18. When I was 32, he was 17 and we had consentual sex throughout our entire relationship. I broke up with him in 8/2009 and in Nov. 09 he raped my daughter at my parents home. He is my sons friend. I know that the law of consent for a minor and an adult to have intercourse is 16, although my mother says that there is a loophole in the law that says that if the 17 yr. old is the friend of the adults child then there can be some sort of sexual charges broought against the mother. He is now threatening that if I press charges on him that he will press charges on me for when we were going out and he was 17/18 and I was 32/33 and we were sexually active.
There is no question as far as charges being pressed on him. I already had my daughter to the care center for raped children and there will be DNA results soon. There is also pictures of her vagina with scrapes on it. He did admit to having sex with her to the police but he says he thought she was 15 and she wanted to do it. I know he knows how old she is and when her birthday is, so he is lying there and I know my daughter never even kissed a boy and that she would not have sex with anyone, let alone her brothers friend and/or her mothers ex-boyfriend. She called me to tell me right after it happened and I went to take her to the E.R.

He should be looking at jail time.

Due to that, he is going to press charges on me as well.
Can I be charged with any sexual offense for any of the above reasons?

Could you be charged? Probably not considering it's been quite awhile ago.

Can he be charged and the charges stick? Oh, yes, they can stick.

Don't let him try to blackmail you with the "well you did it to me" thing.

It's basically his word against yours in the him/you scenerio. You can deny it, you know. But he can't deny the him/your daughter scenerio. Don't let him confuse the two.

I'm in Ohio too. They don't play in Ohio with sexual predators and especially child sexual predators. I am not aware of any loophole where the perp knows the parents. It does not exist.

Press charges. He's a rapist and should spend some time in jail for this - your daughter is a CHILD!! She does not deserve this.

I had to do a little research on this. And from what I can tell (and I am NOT a lawyer) the age of consent is 16 in Ohio. Bottom line.

So, by you having sex with this kid at 17 - you should be in the clear.

I don't understand the "loop hole" you are referring to. It makes no sense to me - most children who are molested or raped - are done so by someone they know. If this loophole where true - a lot of parents would be in jail.

PRESS CHARGES!! Your daughter deserves that much.

If your daughter is stating that she did not consent and that he forced himself on her, then he is guilty of sexual battery. At the very least he would be guilty of Unlawful sexual conduct with minor.

Now for your issue. Since he was over 16 and the sex was consensual it would appear you could not be charged under this law.

On the other hand, you might be charged with child endangerment for allowing this person to be alone with your daughter, though it's a long shot.

I don't know if you carried on your relationship with him publicly. But if you didn't the publicity that will be attached here is going to be very hard on you. A 33 yr old woman having a sexual relationship with a 17/18 year old is going to make you appear as a sexual predator.

I'm not saying your daughter shouldn't press charges, but you need to prepare for the firestorm that will accompany it.
