A verbal rental agreement was made about renting a room in a house.
Agreement included:
$400 a month rent, including utilities.
-furnished room
-no pets in side the house
-use of all of house, including kitchen facilities, & watching t.v.
-private use of own bathroom
-was told never home weekends, & 3 nights a week due to school
-told cat would not live in the house 1 month prior to moving in, due to renter having allergies & asthma & severe allergy to cats
-told 2 dogs were being given away, & 1 cat, after cats shots were given
-room & bathroom would be cleaned & rugs, prior to person moving in
-only people living in the house would be mother & daughter
-food offered once in a while
-use of 1 shelf in kitchen cupboard
-use of 1 shelf in refrigerator
-quiet after 9:00 p.m.
-owner said wouldn't charge for first week, as it would be a trial basis
-agreement was to only charge rent for each day that renter is there.
-renter would be charged for days not there
-owner agreed to changing the locks

Since moving in, the following has occurred:

-teenage daughter plays loud music at night & during the day. Music can be heard outside on the street
-teenage daughter has boyfriend sleeping over on front room couch & in her room
-teenage daugther entertains various boyfriends during week nights until 12:30 a.m.
-3 dogs & 1 cat live at house
-cat lived inside house for first 3 weeks. Even after it was mentioned to owner, due to renter having breathing difficulties, cat was continually brought inside the house. Renter could constantly hear cat meowing & scratching on owner's bedroom door to be let out
-even after renter complained to owner about loud music & late night visitors, & owner said she would talk to her daughter, daughter continued to disrespect renter
-renter has not used kitchen because shelf in fridge is always full of owner's items, & renter has no where to put groceries.
-daughter constantly in t.v. room, so renter unable to watch t.v.
-pestides have been sprayed in the house, due to the cat having fleas
-owner lied about one of the dogs being pregnant, & said the male dog was not interested in female dog
-female dog had 6 puppies
-no attempt whatsoever has been made to give away, 2 dogs & 1 cat. There are currently 9 dogs & 1 cat living at the house.
-owner lied about getting rid of animals
-renter has developed asthma & allergies due to pestides, as well as cat being kept in the house.
-renter has had to go to see a Pulmonary Specialist with regards to breathing problems
-renter had to pay for lock for bedroom door, as teenager was caught in room & using renter's private bathroom
-owner continually denies teenage daughter using bathroom, but has found daughter's hair in bathroom, as well as toothpaste all over the mirror.
-renter has had to take all toiletries out of bathroom, due to fear of teenager using or taking things.
-renter is inconvenienced by having to clean bathroom used by daughter which makes it no longer a private bathroom
-owner said would supply t.v. for bedroom. It has never happened.
-renter continually asks owner if the cat ever slept on the pillow on the bed. Owner denies it, but renter has breathing issues by lying on the pillow.
-daughter takes boyfriend & tries to see in renter's window while renter is showering
-renter asked owner to pay for an air filter for the furnace, due to asthma & allegies. Owner never responded & renter ended up paying for the air filter & door lock.


Should renter have to pay $400/month rent, when services have not been provided?

Well here's the thing. You have a VERBAL agreement. Do you have any proof of this agreement? On the other hand, the landlord has no proof either.

So here's what I would do. Move out as soon as possible. Give the landlord a check for all the days you occupied the room. If he tries to sue you, go to court and present your case.
