In My Father's Legal Separation Papers, It Is Stated That Upon His Death, All Of His Land And Home Goes To His Legally Separated Wife With The Exception Of One Acre That Is To Be Given To His Daughter. He Died In July, 2006 And In September, She Deeded All Of The Land To Her Son. The Legal Separation Papers Are Registered In The Court House. My Question Is - Without Employing A Lawyer, How Do I Sue Her For The Acre Of Land?

Depending on your State's jurisdictional limit, $3000 for some $5000 for others, and the value per acre in the area, you may be able to take her to small claims court. Most attorney's will give you a complementary advice session to discuss your options, and figure out what is the best course of action. You may also want to check into the possibility that this could be considered theft because you did not give this person your acre, and you did not receive any payment for it, so technically it is stolen property.

Do you want the land or do you want the value of the land? If you want the land then you'll need to see a real estate attorney and file a lawsuit to have the court set aside the transfer to her son. You will need to do this immediately to prevent the son from transferring the property.

If you only want the value of the land then you can see a general litigation attorney.
