View Full Version : On Deed but not on Mortgage

My ex husband bought a house in Georgia and added my son to the Deed but he is not on the mortgage. He, my ex, lost his job and got behind on the second mortgage and the HOA dues. The HOA has not been able to reach him and neither has my son. Now they are coming after my son. The HOA has placed a lien on the property. My son is in his final year of college and is unemployed. I do not want this to affect his credit. How can I prevent this from happening?

The HOA lien can effect your son since he is on he deed, no way out of that.
He is not liable for the mortgage, since he did not sign. In fact if the son was added after the mortgage, that in fact may or could cause the mortgage to become payable in full unless they had permission to do it first.
At this point, the son will either need to pay the HOA liens and pay the mortgage to save the house, or he will be effected by the one lien anyway.
Is the first mortgage paid up to date, and why did the HOA place the lien.

He has not paid theHOA fees. The 1st mortgage is current, the 2nd is 2 months behind. Is there any way to remove my son from the deed?
