View Full Version : Kicking out a roommate not on lease

I live in a 2bedroom apt in NYC. I let a former friend take the free bedroom a in July. I am solely on the lease but my roommate does pay her portion of the rent directly to my landlord. My roomates boyfriend has been living here and they are loud all day and all night. I have not yet spoken to my landlord about kicking out my roommate. We have not spoken of any verbal agreement or any such thing. I want to know if my roommate has any rights even though she isn't on the lease. I also want to know how I go about getting her out and how messy it could become. Thanks.

I read this and many other threads before I posted my question. My situation is not really like hers. There are no clauses in my lease about a 3rd party. My landlords know that he is here, they do not mind as long as I am happy. I like my landlords very much so I put on a good face for them. I want to know everything before I make any moves so it is of no hassle to them. I basically want to know if my roommate has any legal right to fight me if I give her 30days notice. The reasons are unimportant to me. If I want her gone and she isn't on the lease is this legal and possible?
