I was arrested last year 2008 April and my visa got expired on AUG 13 th 2009 I am a student on F1 and I went to visa renewal as I am doing my final semister they asked me to get the FBI AND SBI reports. I came back with out stamping ,under administrative process before Aug13 . Later I send the reports and they say that criminal record does exists and now I am in USA and they asked to come and take visa interview and will I get the visa?

I made a mistake it is said that local ordinence violation . And I can apply for exoungment on may14th too. But will I get visa ?

Expungment will not help, police and government agencies will always see all arrests and convictoins. And normlaly you have to wait 8 to 9 years to ask for a conviction to be explunged.

You did not say what you were convicted of, rape or murder ? Shoplighting, armed robbery, or jay walking. That is the biggest issue

Not enough info... but if you are over 18 y/o, expungement is difficult to do and it may not be helpful. Did you have an attorney at the time you were arrested?
