View Full Version : UK Tier1 dependent visa rejected

Hi,
I am currently on Tier 1 General visa and have been staying in the UK for the last 3 years. I want my wife to join me in the UK.
She applied for her Tier1 general dependent visa in Sept09 from India and British High Commission rejected because of low maintenance funds. It was surprising as I sponsored her and gave 3 different bank/building society statements for the last 6 months with good enough balance. It seems that the Visa officer made a mistake and only looked at 1 statement and that too the one with lowest balance.
There was no provision of making an appeal. My wife then applied for tourist visa so that she could visit me for few months, go back to India and re-apply for dependent visa. Now, this time her tourist visa also got rejected as Visa officer is not satisfied that she intends to go back to India before expiry of tourist visa. This time she is given an appeal form along with the rejection letter.
I am not sure what is the best option for me at this stage. Since her visa has been rejected twice in the last one month, I am really cautious about the next step. Should I make an appeal or make a fresh application for dependent visa or is there any other option?
Could anybody please advice?

Sorry to hear that.. but I would like to know that Did she prepare any case before applying for visitor visa ? Case in like why her tier 1 visa got rejected and why does she want to apply for visitor visa... did you give any surety that she will be back within 2- 3 months... if no that it was bound to get rejected... because my case is same as yours but I have not applied for visitor visa.. will be applying in the month of feb... my visa got rejected because of lack of marriage evidence .

Many thanks for answering my question.
In my wife's application for tourist visa, she mentioned in the covering letter that she intends to come back in 2 months. However, we didn't explain explicitly that why dependent visa was rejected the first time.
The reason for that is we made an informal appeal (on a simple letter) when dependent visa was rejected (as advised by one of the administrative staff member in the visa office in Mumbai). We heard that our appeal is rejected in a week's time. That's why we didn't explain it while applying for tourist visa. In hindsight, I guess that informal appeal didn't even go inside the relevant office for consideration.
This time they have given us the form to appeal against rejection of tourist visa. Do you think we should make an appeal or apply for dependent visa again or anything else?

Go for appeal... she will get the visa in 5 months... if you re-apply and then again it may get rejected... y u want to take a risk.. I think if your visa gets rejected for the 3rd also you cannot apply for next 10years... { please check } I am not sure.

Hi,
Best think is sort out your funds and re-apply for dependent visa. Tourist visa is not option but you have 90% chance to get her visa stamped if you fulfill the requirements they questioned earlier. So, no need to go here and there and just stick with main application (tier 1 dependent visa) and re-apply.

I am a british citizen by land which I took it last November 2009. Now, I want my mother who is 77 years old to be my dependent. Before I was still work permit holder and permanent resident, my mother was issued of a tourist visa good for six months. She stayed with me within the regulated period and now she is now living in the philippines. I am the only child and want my mother who is now is elderly to be under my care. She lives alone by herself although I have my half-brothers on my father side but they have their own family. But, they have their own family and unemployed and already old age. She applied for dependent visa recently in the philippines but her application was denied. The reason of the denial is that she has a source of income in the philippines. But, all of the properties she has has already been sold. Now I want to appeal the case but what steps shall I do and what evidences shall I present to convince to grant and approve my appeal. Hi,
I had applied for Family Visit Visa back in 2008 and my visa got rejected for a v stupid thing which was actually my own fault that the sponsor letter I had not provided a sponsor letter from a blood relative.
Second time I applied for family visit again in 2009 and this time it got rejected as I had provided two bank statements confirming funds to cover my expenses during my stay, but I don't know why the hell they saw the statement with the lowest balance and never saw the other one. Anyway, I appealed for it but then I withdrew the appeal as it was taking too long.
Recently I got married last month. My husband is in there with a recently approved Tier 1 General visa for three years. Earlier he had his HSMP for 2 yrs at the end of which he applied and got his Tier 1 easily. Now on Feb 25, I will be applying as a Dependent to my husband. I will obviously hide nothing and will provide rejection letters of both my past family visits as I have nothing to hide and even the rejection reasons weren't as bad.
What I am confused is, that would my earlier rejections have any impact on my application this time? Do they consider applications of people with past rejections differently than those with no rejections? I am v afraid this time. If I provide complete docs this time with nothing less, what are the chances that my previous family visit rejections won't affect my dependent visa?
