View Full Version : Violation of probation for DUI in New Jersey

My probation officer violated me for 2 DUI's (alcohol) I received within a week of each other in New Jersey.

My original charge was ag.assault, first offense... maxed out a six month sentence in county and have done 3.5 of 5 years of probation without incident. First offense not alcohol related, no probation terms saying I can't drink.

I don't know if anyone is familiar with NJ law, but DUI is considered a traffic offense... these happened 8 months ago and my probation officer only found out when the community service order came across his desk for the second violation. He seemed more pissed that I didn't tell him about them.

Furthermore, I have a documented liver condition that can cause my BAC levels to be off. DUI court may not consider that an excuse, but will it hold up in criminal court?

What can I expect when I go to court? Anyone think that I'll get sent back to county? Ordered to do treatment? What is most likely.

Hello s:

A DUI is a serious violation. Two DUI's back to back is FIVE times as serious. I don't know what'll happen. But, I'd hope for the best, and expect the worst.
