What do I do if I have a showcause for childsupport and cannot pay? I have everything for sale and can prove my financial desparity. Problem is I am a successful doctor with a large income. The economy has drastically effected my practice to the point of collapse...

If you are a successful doctor with a large income what is the problem ?

If you are a doctor with low income because of the economy, you go back to court and prove you are making less and ask for less child support.

And you change you spending habits, you perhaps drive a cheaper car, live in lower cost housing, and do other things

Then when you go to court bring your paperwork with you and prove up what your situation is. Are you trying for a reduction or trying to stay child support for a set period ?

I always find it suspect when someone comes to a *free* internet site for legal advice and butchers the English language so dramatically, yet refers to themselves as educated and successful.

Are you trying for a reduction or trying to stay child support for a set period ?Thanks for your reply, I'm at this point trying to give everything I have to the situation. $800 here,$1000 there. I'm making an effort but I don't want to destroy my credit and hers by throwing a yacht or car etc... to the banks. I have everything for sale and pray something relieves this situation. All I hear is that in this county they don't care and you will go to jail. To answer your question I guess a reduction.

So you were a successful doctor. Yes, I used the word were because if you are here looking for a reduction in support because the economy ruined your practice then you can't say successful at the current point. How long ago was support set? You might be able to get a modification hearing if it has been long enough ago just based on the time being passed. Do you have proof that your income is significantly less than when support was set? (by significantly I mean 12-17% depending on the state) It is true that you will need to sell things if you are still making payments on them and can't afford your support. The child support comes before any luxury items. Which of course means that you may have to sell whatever you are still making payments on for less than what you want just to get the payments over with.

I hope your keeping records and can document the payments as you are making them. Have you tried talking to the banks etc who hold the loans and let them know what is going on ? Are the things your selling marital assets ? All of that can come into play. The point of jail is for those that refuse to pay. A change in situation does not mandate jailtime. After all what are they going to get by doing so... nothing. So its in everyone's best interest to keep you out of jail. Are any of the items selling for profit or are they going to just cover the loans ?
