I'm married to a us citizen and overstayed my I94 by 129 days because 1 week before I was due to leave we discovered that my wife was pregnant and she couldn't fly whilst pregnant due to a pre-existing medical conditon, so I stayed until our son was born in February. Two days after he was bron my mother in law threw us out and I immediately began the process of getting my wife and son back to the UK where I could take care of them.

What I want to know is, what length of a ban, if any, am I subject to having overstayed my allowed time on the visa waiver program, as we'd like to go and visit some family in New York next year and I need to know if I will be able to go.

I also still have the tear off part of the I94 as no one took it from me at the airport and I've kept it since we came to the uk in April

You won't be able to enter US for 3 years.
