View Full Version : Husband wants to adopt - Bio donor not on Birth certificate

My husband would like to adopt my daughter. Her Bio donor is not listed on her birth certificate. We live in Rhode Island. Her donor has never seen her. I haven't seen him since I was 3 months pregnant. Would I still have to seek him out so he can terminate his rights and what would the procedure be to get this going? Where would I start?

Let me get this straight: Did you or did you not have sex with her biological father?
If you had sex with him, he's a biological father, not a sperm donor.
A sperm donor has no legal rights. A biological father does.
If he's the biological father, and not a sperm donor, then you DO need to contact him about going to court and voluntarily relinquishing rights so that your husband can adopt.
You start by getting a lawyer.

There are a number of threads here that deal with this issue. A few minutes browsing would have gotten you your answer.
Adoption is a legal process. For a step-parent adoption to go through the parent being replaced has to agree to it. At the very least you have to show a good faith effort to get that agreement.
Where you would start is by consulting an attorney who can prepare the adoption petition for you. The attorney will then tell you what you need to do to get the adoption through.
