I am British and live in the UK. Three years ago I left my wife. She threatened to change the locks so I could not get back in which she did a couple of months later.
A year ago we got divorced. She is living with our 21 year old daughter in the matrimonial 5 bedroom house which is in both names. My ex wife is refusing mediation and I can not afford a solicitor. Because of the recession I have not been working for over a year. I am heavily in debt and can not afford to have a place of my own; I am practically homeless. My friends are letting me stay with them for a while but I can not impose any longer on them. I want to go back to my house to live there until we come to an agreement about the house. What is the legally right way to do so? I do not want her to have me done for harassing her.

Evening fluffy

Having helped several friends with their divorce all I can say is it is not a pleasant business to go through

When you stated you got a divorce, you would have signed final settlement papers stating who got what and what each other person was entitled to/responsible for

I would have presumed that the house would have been dealt within that document

So what does your divorce agreement state?

It is this document that you must address, if it entitles you to re-enter the property but she is refusing then you must apply to the courts for a warrant to be issued against your ex for breach of contract - this is very easy to do and you don't need a solictor for it

Let me know if you need help with this

Also, as you are not working, I would presume you are at the JSA receiving benefits

Part of this is housing benefits, I can appreciate you as a single person (at least without dependants) you might find it difficult to get a house for yourself, however, there are people who offer places of accommodation when you are on housing benefits

So speak to you local housing asscoiation and ask them what is offered and what you can get them to pay for

Let me know on the dicorce statement
