Me and my wife are going through divorce proceedings and things have not exactly been rosey!

Her latest supprise was to ring the police this morning to report me for "pushing her over" now obviousley this is classed as assault and I know this

But after 8 hours in a cell I was released and told that my evidence against the accuser (my wife) was very strong and won the fight for me.
Now I would like to know where I stand, I want to know can I press charges for wrongful accusation? Do I go down the "false allegation" rout?
After all she nearly lost me my job! I work in a care home and you all know how strikt they are if you have a criminal record!
And she also nearly lost me my children too!
Please can anyone help me?

Fighting ain't good for your children. I know. I know. Your wife started it. Ok, somebody's got to stop it. Somebody's got to be an example for your children. Why not you?

Excon is right. If you let it go, be the bigger person, then the divorce may go smoother. However, you need to only be with her when an independent witness is around. Do not put yourself in a position to be charged again.

If you are going to pursue the matter, do it in a civil court. The burden of proof is much higher in criminal court. Plus, you probably can take care of this in small claims court.

Before you do anything, check with your divorce attorney.
