OK my brother is dealy with a situation he dated an illegal person who lives with her parents she was 26 when they met dated got her pregnant they lived together and one day she was 7mths her mother picked her up and did not let my brother see her or the baby 3yrs trying to see his kid they date again but girlfriend and her mother do not let him see his baby now he married her thinking they can be a family and hell see his baby but no she got pregnant again with him now mother in law waits again till she is 7mts and picks her up and does not let him see his kid and the way I see it is mother in law is using her child to have kids and then she takes the kids for income tax and whatever but his wife has stated that she is scared of her mom and does whatever she wants now she his wife is 31yrs old and mind of a kid... what chance do you think my brother has if he fights full custody what can he do please help

Im sorry - I am trying to understand your question but its awfully difficult with the total lack of punctuation and abbreviations.

But as a general rule, if he does not have fill custody now, it will awfully difficult for him to change that against the will of the custodial parent.

I think from the way I read it he IS married now to the custodial parent.

For the OP. He needs to call the police and have the Mother in Law charged with kidnapping. As soon as they try anything.

If the mother is "fit" he will not get full custody but should get joint custody normally.

He has to file. If he did not "see" his child for 3 years that is either they were not found, or he did not go to court and get a custody order with a order for visits and enforce it.

I don't understand something. The OP says the children's mother is illegal but claims the children on her income taxes - why doesn't the brother bring up her illegal status in court?
