My daughter was born out of wedlock and her father has nothing to do with her. I am currently trying to go out of state to visit some family for a little while and sign temp. guardianship papers to my mother. I was wondering if I had to have his signature for her to get the guardianship. We live in Illinois I have never took him to court I have never received a dime. I was thinking since I was not married haven't been to court his rights haven't actually been established please help me out!

You are correct in your thinking. Until he extablishes paternity he does not have any say in what you do.

One thing that your missing here is that if you take the child without his knowlage and try doing that what your really doing is setting yourself up to turn the child over to him should he go to court and ask for HIS child. Why are you giving up the child ?

Yes, if you move out of state, he could file withint a reasonalbe time to force you to either move the chlld back or to give him custody.
You should have and should file for full custody and get a court order and of course force him to pay child support.
If you don't, he can come back almost anytime ( often perhaps when it is worst for you) and file.
