I was Charged with possession Of cocaine. I was at a hotel room with An 18 yr old and a 60 yr old male I am 20 years old. There reason for coming to our room is because they thought we were prostitutes since we were with a 60 yr old male. In the room they found crack pipes and a spoon and expty baggies. In my friends car they found crack that I new nothing about.. but they charged all 3 of us with it. I am out on a PR bond right now and I have not seen my lawyer yet. Im scared this will turn out bad , I was charged before for the same thing and it got dismissed. Any ideas about how this may turn out? Im hoping for the best and expecting the worse. Thank you.

The type of scenerio you painted does not bode well. Two young girls with an old man definitely sounds like sex for sale with some drugs mixed in for more fun.

If there were crack pipes in the room and a spoon for the cocaine's use it does not matter who's cocaine it was.

Seeing as this is a second time for you things will not go so lightly for you as you already used up your first chance to change your ways. Listen to what your attorney tells you to do and don't repeat this activity again. You might just get a year's probation with no jail time. But if you do get probation just remember if you mess up in the time you are on probation you may just have to do that time in jail. Follow the probation rules to the letter and be a model probationer.

We only got charged with the cocaine in the vehicle. We were not charged with paraphernalia. I was curious if they can even bring that up in court?

Well we were in a hotel me and my 18 yr old friend and my boyfriend. The police said they come to our room because they thought we were prostitutes. They said they were going to search the room so asked if there was anything illegal. I told them about the pipes and spoon. They then asked questions and what not. Eventaully they searched the car and found some crack in there which I new nothing about it was in My friends car Its not me or my boyfriends. They arrest all 3 of us after they tell us all we are going home. They don't even tell us what were charged for until were in the police car and the way he said it was when I asked him his response was " I guess your arrested for the cocaine. They were young punk cops, they had no clue what they were doing.

If it went down like you said, the search was illegal and the charges should be dropped. However, the cops are going to say it went down differently. You're going to need a lawyer.

The 60 year old man is your boyfriend?

If you weren't doing drugs then who was? There were pipes etc in the room, obviously the last occupants didn't leave it there, so who did?

I'm not a legal expert but I don't think you're going to get off on this one. You got off the first time and you can be sure that the judge will be informed that this is your second offence.

One thing is he is still married he hasn't even gotten a divorce.. he doesn't see his wife at all but I just wonder why he hasn't done that yet..

I was doing drugs that night I told the cops that but the stuff they found in my friends car was not mine I honestly didn't know about it. And the charges I had before are not on record it was dismissed

I really suggest getting a lawyer, that's your best bet.

Me going to jail would not help anything, yeah I've done things wrong in my life but Im a good person I work 40 hours a week to help my mother. Ive learned my lesson from drugs and don't plan on using them again.

It would have been a lot easier if you had learned your lesson the first time.

The thing is, do we believe you? I'm sure you said the same thing the first time, which is probably why the charges were dismissed. Now you're saying it again, but you've already proven that your word doesn't mean much.

That's what the judge is going to take into consideration.

You really need a good lawyer and then you need to get your life back in order and keep it there.

Is this charge a felony? I would think you have a chance at probation and reduction to a misdemeanor if it's not already that. The charge is going to stick your not going to be able to get it dismissed again. Unless a lawyer can get it throw out for some legal reason. You want to try and avoid a felony conviction. Maybe ask the lawyer is it possible to expunge the misdemeanor in the future.

The police are going to think he is a dealer or you're a prostitute.Why would a 20 year old girl hang out with a 60 year old guy who isn't a family member in some motel. Besides legal trouble your safety is at danger,the guy is a least looking for free drugs or to scam you. He probably wants sex,your at risk for rape,being attack,etc. Please avoid this guy.

You need to hire a lawyer or get a legal aide if can't afford one. Tell them the whole story even it looks bad it help them arrange the best deal for you. Maybe they can get thrown out on some loop hole. A lot times even arrest record pop up on a background check for a job,an employer seeing 2 arrest for crack isn't going to look good. Even if you get arrested again for a misunderstanding the past arrest can effect your bail and other results. Cops,da can be there going to care about your or your family.

Get a lawyer,good luck and take care.

If the police came to the door and you allowed them to come in and then answered their questions, then there was no illegal search. The cops have the right to knock on your door and ask you question. You have the right to not answer the door or their questions. If you gave up the goods, oh well. Lesson learned.

The police are going to have difficulty proving that the drugs in the car were yours. They may have had probable cause to arrest you for such, but proving the possession beyond a reasonable doubt is another thing. Their proof is stronger on the cocaine residue in the pipes.

Of course, the scenario you describe above is much more probable than the cops just walking in, as the OP implies... Most people, when asked by the cops if they can come in, or if they can "look around", cave.

There are, however, some cops, in some podunk little towns, mainly in the South, who will barge right in and start turning the place upside down. Hence, my advice. I probably should elaborate more. Good for you for doing so.

Obviously breaking the law has consequences, but if the jails in the US are anything like here, drug offences for personel use should never be sent to Jail

The prisons in this country are supossed to be drug free and yet every prison has a "Drug Free Landing", which means they guarantee that part of the prison has no drugs in - I ask you!! :confused:

A friend is a prison guard for a female prison, and it is their experience that if they clamp down on cannabis, it leaves the prisoners a choice of the harder drugs, which in turn creates more problems, especially with highly strung scenarios - so they have a "it if they dont see it, they dont stop it policy" its provides tranquility

I can appreciate the purpose of jail is to teach someone a lesson, but the reality is so far different

When two different stories are posted I tend to believe half of each. I'm not sure what the "story" is here and, therefore, have no idea what the Police can and cannot prove.

First you were trying to destroy "evidence" throwing them in the water bowl, which of course is actually another crime into itself which you just confesed to HUMMM.

But yes residue is cooked or burnt onto the pipe and can be found long afterwards.

Now having the drugs in the car, and if you were riding in the car, ( if you confessed to them that you rode in the car their with them puts you in the car with the drugs.

In Georgia anyway, if there are 4 people in a group and one has drugs on them, all can be chanrged.
The charge for the pipes and other items will most likely stick, and they will most likely offer you a good deal if you testify against who the drugs actually belonged to.

In NY there is the pesky charge of "attempting to destroy evidence" and, yes, everyone is charged.

I am not a chemist, nor an expert on the subject, but I know the test can pick up traces of cocaine from even cross contamination. Thus, unless the pipes were scrubbed clean, then the answer is probably yes.

Giving your facts further consideration, if they didn't charge you with the pipes, they may not put in a request that they be tested. So, don't spend too much time worrying. Just make sure you speak with your attorney before court.
