Are you trying to get out of the summons by telling the court your'e out of a job?

I'm not a legal expert but I don't think unemployment will dismiss anything.

You put this under the small claims category. How much are you being sued for? When is the court date? Do you owe the money?

There are many legal experts on this board, sadly I don't think any of them are on line at the moment. Check back often. :)

If you are being sued for a delinquent debt then ariting a letter that you are unemployed won't do anything. Inability to pay is NOT a defense.

I suggest you browse through this forum (as well as the Credit and Bankruptcy & Debt forums). You will find loads of threads from people in similar circumstances and loads of advice on how to proceed.

Agree, you must show up on your court date. Writing a letter does no good, speak directly to the court. In all likelihood there will be a judgement againist you if the debt is legit but failing to pay the judgement can not land you in jail. Try to work out a payment plan or make an offer
