I have a slight problem. I have a bank of america credit card that I have been paying on time for 6 years now and in 2008 I lost my job and have been on unemployment for a year now and it is coming to an end. I called bank of america and told them my situation and they said all they can do was offer me a lower interest rate but I already had an awesome 3.9% fixed apr and they couldn't do any better than that.

I cannot find work because of a disability and I applied for social security help but the hearing for that takes up to 2 years and I have a lawyer helping me but its all a waiting game till I get a hearing. I told bank of america this every time they call me. But of course everyone who calls is new and all there job is to get my late payments. I expect a hearing to be somewhere in the middle of 2010.

Now my question is I have to stretch what money I have left to pay my truck payment until I get the hearing. Can they freeze my bank account. Will I know in advance so I can get all my money out of there. Also it's a joint account. I manage my elderly mothers money too. If I dump all my money into here account and they freeze my account will both accounts be affected. Once I get the Social security help I will start repaying the credit card but seems they are not willing to wait. What should I do??

First I would take it out of Bank of America if you have it there first, often some hidden clause allows them to just take it, without court action from their own bank.

Next does your bank card have a arbitation clause, is so, many have the right to bypass courts , have it heard by a board, and when they rule in the credit card favor, they are allowed to file a summary judgement.

Next no don't mix the money, if you do, that could be considered fraud and they could if they follow the money, freeze the other account also.

Take it out and put it under the mattress or safety deposit box

Yes my bank account is bank of america. My truck loan is Bank of america.. my credit card started as MBNA and bank of america bought Mbna I guess. Ya So Im basically screwed. OK great
