View Full Version : Which State do I petition for early termination of probation?

First offense and would like to apply for early termination of probation. Aside from the eligible date to request same, which court do I petition: The court in the State that charged me with my offense; or do I apply for this in the current state for which I am now living? Who has jurisdiction to award me early termination of probation, provided I am in full compliance with terms for consideration?

Was probation transferred or did you simply move?
I researched this - good question, by the way - and I would say it's the State which PUT you on probation; if you moved with permission and your probation was transferred, then it's the State where you are now.

It would be my view that jurisdiction in the case remains with the sentencing court. The receiving state has agreed to take on supervisory responsibility only.
I hate to disagree with my friend, Judy - especially after she said she researched it.

And you are probably right - my research referred to "transferred probation" which I assume meant the entire package regarding probation.
Didn't check (or read) anything about supervisory responsibility.
So I bow to your expertise - you are also good lookin' and a fine dancer.

The state that put you on probation in the first place. The other state is just babysitting you for them until your probation is completed.
How long have you been on probation and how long was your probation originally for?
