My sister threw my niece out in the street because they don't get along and since she had no place to go she's staying with me, her aunt. My sister came to the house 2 weeks with the police and wanted her daughter to return home who is 16 and the police let her stay with me because my sister seemed unstable. She is now taking me to court for custody of her daughter. They spent 1 hour together today and my niece cried all day because her mother told her she wish she never had her. My question is this, my sister is on retirment disability and refuses to support her daughter and taking her to court would take months, any suggestions? I think she's getting a check for my nieces as well and she currently doesn't live with her. Thanks

I don't know what your point is lisa, unless you want to know how to get custody of your niece permanently. It sounds like a mixed up family matter with a mom who is just too screwed up to care what happens to her daughter. Can you explain exactly how you want to handle this issue? And we can go from there.

If there is a pollce report stating that the police came, found the mom unstable and excited, etc. then there is already grounds for intervention. Everything has to be documented, LisaRD.

You let it take months if that's what it takes and get her into court. You can also file an exparte order with the courts granting you temporary custody of the child. Once you receive it then you would notify SSD of a change of address for the child. You should be receiving the checks for her since she is living with you and to help offset expenses.
