I am in default with a car loan,the car is still in my possession and I have to request for a hearing to address this matter. I want to receive a later hearing. I hope to be able to make payment arrangements with the lien holder.

Your car loan is a contract - where do you want to schedule a hearing to change its terms?

Inability to pay is neither a cause or a defense so I don't understand why you think you can change the original contract.

If you are delinquent, why hasn't the car been seized and auctioned - ?

Judy, I think they meant that they are being sued for defaulting on their car loan. They now want to file an extension or something similar, in order to attempt to work out an arrangement with the lienholder. At least that's what I'm reading...

If that is the scenario, then your best bet is to attempt to negotiate payments outside of court. Get something in writing but still show up for the hearing. Bring the written agreement with you and the judge will usually continue the case; if you default on payment again, then a judgment will be placed against you.

This8384, you could be right. I read " i have to request for a hearing to address this matter" to mean that the OP is attempting to schedule a hearing, not responding.

But then again - who knows@!
