View Full Version : Is it a probation violation if someone files a police report against me?

I didn't have any contact with any police officers, I know that would be something I would have to tell my probation officer. I am on probation for telecommunications harassment. I used to date this guy who lived with his dad and grandma. He would rarely answer his cell, so I called their house to get ahold of him. They got tired of me calling and hanging up randomly to get his attention, charged me, which led to probation for a year for me..
I have obsessive behaviors and am seeing a counselor for this as ordered by the Judge.
Boyfriend and I are no longer together, however, I'm having a hard time letting it go. I called his friend last week to get a hold of him. His friend got tired of it and filed a police report, but did not charge. I know that if he charged, it would automatically be me in jail, right? But since he didn't is that the same thing? I only know this because he texted me and told me. I don't see probation officer again until the end of October.. is this a big problem? Like I said, I had no contact with police, my ex's friend is the one who told me he filed a report.. does this news get to my probation officer right away? Or do I have to tell her? I'm just wondering if it is a violation and if I should be worried about going to jail right now..

Well, it what you are doing is bad enough for someone to call the cops, you are treading a fine line.

Just because the cops are called does not automatically violate you. For all you know, he didn't actually call... and was just trying to scare you.

But seriously... reel it in... cause you ARE walking a fine line and on the other side of the line is jail.

What is important is not the fact that a report was taken or even an arrest made, it is the behavior involved. Your behavior of making unwanted calls to anyone can be considered a violation of probation. It could be considered criminal behavior, whether you are charged or not.

Your P.O. should have given you a written "conditions of probation." You must refer to your "conditions of probation" to know if this is something that you must tell your probation officer. If you are only obligated to tell the officer of arrests or tickets, then this would not qualify.

You need to seek additional help for your problem. If not, you will be in jail.
