I attend a Church in which the Board of Directors is appointed by the Senior Pastor. In addition, all pastors become a member of the Board of Directors. Since all of the pastors are paid by the Church, doesn't this create a conflict of interest that could jeopardize our 501(c)3 status? Also, the board meets without notice to the Congregation. I'm curious if this causes any issues also?

I'm not certain of the law for Churches, as they have special regulations, but our Homeowners Association is also a 501c3 and the Board meets quarterly while the entire association meets annually. As far as Pastors on the board, are they all voting members?

Yes, they are all voting members.

Hello tt:

Charitable organizations can pay their employees without jeopardizing their tax status. The church can determine who works for them.

The BOD meeting, if private, doesn't jeopardize it either.

excon: Surely you would agree, if the Church were to pay one of their boardmembers $1mm when the annual Church budget is $1mm, they would lose their 501c3. I'm not sure you are knowledgeable on this subject.

Hello again, tt:

What I'm knowledgeable about is English... In case I missed something, I read your question again. You didn't SAY anything about the salary's being OUTRAGEOUS. You didn't say anything at all about that. How, prey tell, would I KNOW that??

I answered the question that was asked. If you want to ask another one, go ahead. But don't give me crap because I don't read minds.

Now, if you want to tell us EVERYTHING, we can help. But, if you want to tell us part, and expect us to give you good legal advice, or argue with us because we ain't mindreaders, you'll get what you're getting.
